Terms of Service

The service

Answergist, operated by Wilphia LLC (“we”), provides AI-visibility audits — reports on how ChatGPT, Perplexity, and Google AI Overviews answer buyer questions about your product — and, for paying subscribers, weekly re-scans and a generated fix pack built from those audits. By using Answergist you agree to these terms.

Accounts and eligibility

Signed-in features require an account. You can sign in with a magic-link email or with Google; we never store passwords. You're responsible for keeping access to your email account and Google account secure — anyone who controls them can access your Answergist account. You must be at least 16 and able to form a binding contract to use the service. If you use Answergist for an organization, you represent that you're authorized to bind it to these terms.

Free audits

Running a free audit requires signing up: enter your site and a work email at that same domain, and confirm the link we email you. We still limit free audits to 3 per IP address per day, and each audit's report lives at a shareable, unguessable link. Each domain gets exactly one free scan, ever — see below for how confirming also decides who owns it.

Verification, listings, and sponsored placements

Confirming your signup link does two things at once: it creates your account, and — if you're the first person to confirm for that domain — it verifies you as its owner. If someone else already verified the domain first, you can still confirm and sign in, and you can still run the domain's one free scan if no one has used it yet; you just won't become the owner. Ownership, once set, doesn't change hands on its own — see the dispute paragraph below for how transfers work.

Listing a site on the public Visibility Index still requires verified ownership — no one else can list a site on its owner's behalf. Sponsored board placements can be bought without verification, subject to these terms, and do not confer ownership. Listing is opt-in and free: once verified, you choose whether your score and report summary appear at an indexable page for your domain, and you can remove it anytime from your account. A removed listing's page immediately returns an HTTP 410 (Gone) and is excluded from future sitemap updates.

Anyone may buy a labeled spot on the homepage board for a domain. Rank is the all-time total of non-refunded payments on that domain. Direct payments are whole US dollars from $1 to $999,999. After you accept these terms on a placement, paid subscription invoices for your account add to that listing at no extra charge. A subscription trial places a labeled trial seat at plan price: it is shown below the paid rows, does not rank, and comes down when a trial ends without a paid invoice. Paid invoices are unaffected. Paying on a domain someone else already owns adds to their listing; it does not create a product for you or steer your invoices there. A bid buys placement only: it never includes a scan and never changes a score.

A sponsored placement is a one-time purchase that begins immediately on payment, not a subscription. It is non-refundable for every buyer, including anonymous buyers. By paying you consent that performance starts right away and waive any EU/UK statutory right of withdrawal that would otherwise apply to this kind of instant digital service (restated at checkout).

When you bid you warrant that you are authorized to advertise that domain, that the listing is lawful, and that you are not impersonating another person or business. Do not bid to promote illegal goods or services, malware, phishing, or content we reasonably believe will harm visitors. We may hide a listing from the board without a refund if it violates these terms; hiding does not void the payment. A refund or card dispute is what removes spend from rank. Ownership disputes — including a domain that changed hands or a mailbox shared by more than one person — are resolved by our support team; contact us and we'll sort it out.

Subscriptions, trials, and billing

Paid plans are Starter ($39/month) and Growth ($99/month), billed monthly in US dollars through Stripe. Both include a 7-day free trial; a card is required to start the trial, and the first charge happens when the trial ends. You can end a trial early by paying: the charge happens that day, your billing month starts then, and the trial's remaining days are forfeited. Subscriptions renew automatically each month until canceled. Prices may change; we'll email account holders at least 30 days before a price change takes effect, and it applies from your next renewal after that notice.

Billing disputes

If you believe a charge is wrong, tell us within 30 days of the charge and we'll investigate and correct genuine errors. Contacting us first usually resolves things faster than a card dispute.

Refunds

We don't issue refunds for partial months. If you believe you were billed in error, contact us and we'll make it right.

Cancellation and termination

You can cancel your subscription anytime from Manage plan in your account; cancellation takes effect at the end of the current billing period and you keep access until then. You can also request account deletion (see the privacy policy). We may suspend or terminate access for violating these terms — including the acceptable-use rules — after notice where practical. If we terminate without cause, we'll refund the prorated remainder of the current period.

Acceptable use

Don't use Answergist to scan a site you have no legitimate interest in; don't automate requests or otherwise get around the free-audit limits; don't probe, disrupt, or overload the service; don't resell audit results as your own service without our written agreement; don't buy a sponsored placement to impersonate another business or to advertise unlawful or harmful content; and don't use the service to violate any law or third-party right.

Third-party AI engines

Audits work by asking real questions of AI engines — ChatGPT, Perplexity, and Google AI Overviews — that we don't control. Their answers, availability, and behavior can change at any time, which is precisely what Answergist measures. We're not affiliated with or endorsed by the companies behind those engines, and an outage or change on their side may delay or alter scan results.

Generated content and your responsibility

Fix-pack content — FAQ pages, comparison drafts, checklists, llms.txt files, and similar — is generated for you and provided as-is. Review it before publishing: you decide whether and how to publish it on your own site, and you're responsible for what you publish. We don't guarantee that publishing it will change how any AI engine cites or ranks your product.

Accuracy of scores

Scores and every other metric on Answergist are estimates derived from a sample of stored engine answers at a point in time. They change as engines change their answers and as we re-scan — treat them as directional, not as a certified measurement.

Your content and ours

You own the audits, fix-pack files, and other content generated for your account, and you can use them however you like. We own the Answergist service itself — the software, scoring methodology, site content, and the Visibility Index — and everything not specifically generated for you. You give us the limited license needed to run the service: to fetch and analyze the site you submit, store scan results, and display report pages at their unguessable links.

Feedback

If you send us ideas or feedback, we can use them to improve the service without owing you anything — but we'll never name you in connection with them without your permission.

Publicity

We won't use your name or logo as a customer reference unless you agree in writing first.

Confidentiality

If you share non-public information with us through support (or we see it while helping you), we'll use it only to provide the service and won't disclose it, except where the law requires.

Privacy

Our privacy policy explains what we collect, why, who we share it with, and your rights. It's part of the deal: privacy policy.

Data export and deletion

You can download your fix-pack files from your account while subscribed, and your report links keep working after cancellation. If you want a copy of your data or want it deleted, email us — the privacy policy describes the process and timelines.

Disclaimer of warranties

Answergist is provided “as is” and “as available,” without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We don't warrant that the service will be uninterrupted, error-free, or that scores reflect any engine's future behavior.

Limitation of liability

To the maximum extent permitted by law: neither party is liable for indirect, incidental, special, consequential, or punitive damages, or lost profits or revenue; and our total liability arising from the service is capped at the fees you paid us in the 12 months before the claim (or $100 if you've paid nothing). These limits don't apply to your payment obligations or either party's liability for willful misconduct.

Indemnification

If a third party sues us because of content you submitted or published, or your violation of these terms or the law, you'll defend and indemnify us against that claim. We'll notify you promptly and let you control the defense, and we can participate with our own counsel at our expense.

Governing law and venue

These terms are governed by the laws of the State of Washington, USA, without regard to conflict-of-law principles. Courts located in King County, Washington have exclusive jurisdiction, and both parties consent to personal jurisdiction there. Nothing here limits consumer rights that your local law grants you and doesn't let you waive.

Changes to these terms

We may update these terms as the service changes. We'll post the revised terms here with a new effective date, and for material changes we'll email account holders at least 14 days before they take effect. If you keep using the service after that, the new terms apply; if you don't agree, cancel before they take effect.

General terms

These terms plus the privacy policy are the entire agreement between us about the service, and they supersede any earlier discussions. If a court finds part unenforceable, the rest stands. Not enforcing a term isn't a waiver of it. You can't assign these terms without our consent; we may assign them in a merger, acquisition, or sale of assets. Neither party is liable for delays caused by events beyond reasonable control. Formal notices to us go to the email below; notices to you go to your account email.
